Terms of Service

1. Acceptance of Terms

By accessing or using Parcost's services, including our point of sale, scheduling, inventory management, and payroll platforms (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.

2. Description of Services

Parcost provides cloud-based restaurant management software, including point of sale systems, employee scheduling, inventory tracking, recipe costing, time and attendance tracking, and payroll preparation tools. Our Services are designed to help restaurant operators streamline their operations.

3. Account Registration

To use our Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Subscription and Billing

Pricing

Our Services are offered on a subscription basis. Pricing is per location per month as displayed on our website. Founder's pricing is locked in for the lifetime of your account for customers who sign up during the promotional period.

Free Trial

We offer a 14-day free trial. No credit card is required to start your trial. At the end of the trial, you may choose to subscribe or your account will be limited to free tier features.

Billing

Subscriptions are billed monthly in advance. You authorize us to charge your payment method on file. If payment fails, we may suspend access to paid features until payment is received.

5. Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. We do not offer refunds for partial months. Your data will be retained for 30 days after cancellation, after which it may be permanently deleted.

6. Acceptable Use

You agree not to:

  • Use the Services for any illegal purpose
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Services
  • Resell or redistribute the Services without permission
  • Use the Services to compete with Parcost

7. Data Ownership

You retain ownership of all data you submit to our Services ("Your Data"). You grant Parcost a license to use Your Data solely to provide and improve our Services. We will not sell Your Data to third parties. Upon account termination, you may request export of Your Data.

8. Intellectual Property

The Services, including all software, designs, text, graphics, and other content, are owned by Parcost and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR ANY THIRD-PARTY SERVICES OR INTEGRATIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARCOST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Parcost and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Services. Your continued use after changes constitutes acceptance of the modified Terms.

13. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Services ceases immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware.
